These Terms of Service ("Terms") govern your access to and use of the Borrow That marketplace, websites, and services (the "Platform"), operated by Borrow That LLC ("Borrow That," "we," "us," or "our"). By creating an account, listing an item, or requesting a rental, you agree to these Terms. If you do not agree, do not use the Platform.
Borrow That is an online marketplace that connects people who own tools, home goods, gear, and equipment ("Owners") with people who wish to rent them ("Renters"). Borrow That is not the owner, seller, or renter of any listed item. Any rental is a direct agreement between the Owner and the Renter, and Borrow That acts only as a venue and payment facilitator. We do not inspect, endorse, or guarantee any item, Owner, or Renter.
You must be at least 18 years old and able to form a binding contract to use the Platform. By using the Platform you represent that the information you provide is accurate and that you will keep it current.
Owners must register for an account to list items. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly of any unauthorized use.
A Renter may cancel free of charge up to 24 hours before the rental start date; any authorized hold or captured charge for that rental will be released or refunded. Cancellations made less than 24 hours before the start date are non-refundable, except where the Owner cancels or fails to provide the item, in which case the Renter receives a full refund. Owners who cancel confirmed rentals may be subject to removal from the Platform.
If a listing states a security deposit, Borrow That places a separate authorization hold for that amount on the Renter's card when the Owner approves the booking — the deposit is held, not charged. The hold is released when the Renter returns the item in good condition and the Owner marks it returned. Deposit funds are captured (in whole or in part) only if Borrow That resolves a damage or loss claim in the Owner's favor after review; an Owner cannot charge a deposit unilaterally. Authorization holds may expire after approximately one week under card-network rules, in which case deposit protection may lapse for longer rentals. By booking, the Renter authorizes Borrow That to save their card and place and, where warranted, capture this hold in accordance with these Terms.
You may not list or rent items that are illegal, stolen, recalled, or unsafe, and you may not use the Platform to harass, defraud, or harm others, to circumvent our fees, or to violate any law. We may remove listings and suspend accounts that violate these Terms.
The Platform and all listed items are provided "as is" and "as available." To the fullest extent permitted by law, Borrow That disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Renting and using equipment carries inherent risks; you assume all risk arising from your use of any rented item. Borrow That is not responsible for the condition, safety, legality, or performance of any item, or for the conduct of any Owner or Renter.
To the fullest extent permitted by law, Borrow That and its members, officers, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, arising out of or relating to your use of the Platform. Our total liability for any claim relating to the Platform will not exceed the greater of the fees we earned on the transaction giving rise to the claim or fifty U.S. dollars ($50).
You agree to indemnify and hold harmless Borrow That from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your listings, rentals, use of the Platform, or violation of these Terms.
These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law rules. You agree that the exclusive venue for any dispute that is not otherwise resolved will be the state or federal courts located in Franklin County, Ohio, and you consent to their jurisdiction.
We may update these Terms from time to time. Material changes will be reflected by the "Last updated" date above. Continued use of the Platform after changes take effect constitutes acceptance.

This Privacy Policy explains how Borrow That LLC ("Borrow That," "we," "us") collects, uses, and shares information when you use the Borrow That Platform.
We do not sell your personal information.
Data is stored with our service providers using industry-standard safeguards, including access controls and encryption in transit. No method of transmission or storage is perfectly secure, and we cannot guarantee absolute security.
We use browser local storage to keep you signed in. We do not use third-party advertising cookies.
We retain account and transaction information for as long as needed to operate the Platform, meet legal and tax obligations, and resolve disputes.
You may request access to, correction of, or deletion of your personal information by emailing hello@borrowthat.com. We will respond consistent with applicable law.
The Platform is not directed to and may not be used by anyone under 18.
We may update this Policy; the "Last updated" date reflects the latest revision.

This Rental Agreement ("Agreement") applies to every rental arranged through the Borrow That Platform and forms a binding contract between the Owner and the Renter of the item. Borrow That LLC facilitates the transaction but is not a party to this Agreement. This Agreement incorporates the Borrow That Terms of Service.
The Owner agrees to rent, and the Renter agrees to rent, the item identified in the confirmed request for the dates and daily rate shown at the time of booking (the "Rental"). The specific item, dates, and total for each Rental are recorded in the Renter's request and the Owner's dashboard.
The Renter's card is authorized (held) when the request is submitted and charged when the Owner approves the Rental, as described in the Terms of Service. The rental total includes the Platform processing fee.
If a listing states a security deposit, Borrow That places a separate refundable authorization hold for that amount on the Renter's card when the Owner approves the booking — the deposit is held, not charged. The hold is released when the Owner marks the item returned in good condition. Deposit funds are captured (in whole or in part) only if Borrow That resolves a damage or loss claim in the Owner's favor after review. An Owner cannot charge a deposit unilaterally, and neither party settles deposits off the Platform.
The Renter is responsible for loss of or damage to the item beyond ordinary wear while it is in the Renter's possession. If damage or loss occurs, the Owner may report a claim through the Platform; Borrow That reviews each claim and may capture some or all of the security-deposit hold in the Owner's favor. Late returns may incur additional daily charges as agreed between the parties.
The Renter assumes all risk arising from possession and use of the item. To the fullest extent permitted by law, each party is responsible for its own acts and omissions, and Borrow That has no liability for the item's condition or use or for any dispute between the Owner and Renter.
Each party agrees to indemnify and hold harmless the other party and Borrow That from claims arising out of that party's breach of this Agreement or misuse of the item.
This Agreement is governed by the laws of the State of Ohio, with exclusive venue in Franklin County, Ohio.
This Agreement, together with the Terms of Service and the confirmed booking details, is the entire agreement between the Owner and Renter regarding the Rental.

Borrow That connects neighbors to rent tools, gear, and equipment. Every rental ends with a real-world handoff, so here's how the exchange works and how to keep it safe for everyone.
Keep everything on Borrow That. Arrange pickups and pay through the platform. If something goes wrong, an on-platform record of your messages and payment is what lets us help. Anyone pushing you to chat, pay, or "settle up" off-platform is a red flag.
If a listing has a security deposit, Borrow That places a refundable authorization hold on the renter's card when the owner approves the booking — the deposit is held, not charged, and is released automatically once the owner marks the item returned in good condition. If there's damage or loss, the owner reports a claim through the app; Borrow That reviews every claim and only then may charge part or all of the deposit. An owner can never charge a deposit on their own. Keeping your messages and photos on the platform gives us a clear record to resolve claims fairly.

To rent out your items and get paid, connect a payout account. Renters can only book your listings once this is set up. Payouts are handled securely by Stripe.
Verify your ID to show a badge on your listings and rental requests. It helps people feel comfortable on a first rental, before either of you has any reviews. Nothing is locked behind it — you can list, book and get paid without it. Stripe checks your ID; we never see it.
Permanently delete your account and all of your listings. This cannot be undone. Rental requests you've received are kept for recordkeeping but are no longer linked to you.
